Terms of Service

Welcome to Sniffy. By using the app or our website, you agree to these terms. Please read them carefully.

1. Acceptance

By creating an account, downloading the app, or otherwise using Sniffy ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the service

Sniffy is a pet tracking, routine-management, and AI-assisted information service for cat and dog owners. It helps users track their pet's health, habits, medications, appointments, diary entries, walks, food, and spending. We may add, change, or remove features at any time.

3. Accounts

• You must be at least 13 years old (or the minimum age in your jurisdiction) to create an account.
• You are responsible for keeping your password secure and for all activity under your account.
• Provide accurate information when signing up, and keep it up to date.
• One person per account. Don't share accounts.

4. Your content

Pet records, photos, notes, prompts, chat messages, and other content you add to Sniffy ("Your Content") belong to you. You grant us a limited, worldwide, royalty-free license to host, store, process, transmit, display, and back up Your Content solely so we can provide, secure, maintain, and improve the Service for you. This license ends when you delete the content or your account, except to the extent we need to retain it for legal compliance, fraud prevention, dispute resolution, or backups that are purged on a regular cycle.

As between you and Sniffy, any AI-generated responses produced for you through the Service are yours to use, subject to these terms and the usage limits and restrictions of our AI providers. You remain responsible for how you use those outputs.

5. Acceptable use

You agree not to:

• Use the Service for purposes unrelated to caring for, managing, or learning about pets.
• Use the Service for anything illegal or to harm others.
• Upload content that infringes someone else's rights.
• Use the AI features for non-pet-related requests, harmful instructions, spam, harassment, or attempts to bypass usage limits or safeguards.
• Attempt to probe, scan, or breach the security of the Service.
• Scrape, reverse-engineer, or resell the Service.
• Use automated means to create accounts, flood the API, or overload our servers.

6. Subscriptions & billing

• Sniffy may offer a free tier, a 3-day introductory trial, and optional paid subscriptions. Current pricing, trial details, and feature availability are shown in-app before purchase.
• Free or trial access may include reduced AI usage compared with paid plans.
• Paid subscriptions are billed through the App Store, Google Play, or other platforms at the rate and interval you select. Those platforms' terms govern billing, refunds, and cancellations.
• You can cancel at any time from your platform's subscription settings. Your paid features continue until the end of the current billing period.
• We may change prices with at least 30 days' notice. Changes don't affect a billing period already paid for.

7. AI features, accuracy, and limits

AI features may be rate limited, throttled, restricted, suspended, or reset on a daily basis based on your plan, trial status, fair use, abuse prevention, technical constraints, safety rules, and overall system load. If you reach a limit, some AI features may stop working until your usage resets or until expanded access is made available through a paid plan or other in-app option.

You are interacting with AI. Chat responses, health insights, and similar features are generated by large language models, not by a person. Indicators in-app (such as the assistant name and AI disclaimer banners) identify AI-generated content.

AI responses may be wrong. AI can produce information that is inaccurate, incomplete, out of date, or fabricated. Treat AI output as a starting point, not a final answer. Verify anything important with a qualified source before acting on it — and see Section 8 for pet health specifically.

8. Not veterinary advice

Sniffy is not a substitute for professional veterinary care. The Service is a pet tracking and routine manager with AI-assisted informational features. Insights, reminders, and AI-generated suggestions are informational only and are not medical, veterinary, diagnostic, or treatment advice. Always consult a licensed veterinarian for diagnosis, treatment, or any concerns about your pet's health. In emergencies, contact an emergency vet immediately and do not rely on the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that data will never be lost. Keep your own backups of anything irreplaceable.

10. Limitation of liability

To the fullest extent permitted by law, Sniffy and its operators are not liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of your use of the Service. Our total liability for any claim related to the Service is capped at the amount you paid us in the 12 months before the claim arose, or USD $50, whichever is greater.

11. Termination

• You may stop using the Service and request deletion of your account at any time.
• Account deletion may be processed as a scheduled deletion with a grace period before permanent removal.
• We may suspend or terminate accounts that violate these terms, with notice where practical.
• Sections that by their nature survive termination (ownership, disclaimers, liability, governing law) remain in effect.

12. Changes to these terms

We may update these terms from time to time. Material changes will be posted here and, where significant, announced in-app or by email. Continued use after changes take effect means you accept the updated terms.

13. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Subject to mandatory consumer-protection law, disputes arising from or relating to the Service or these terms will be brought in the courts located in Ontario, Canada.
